The document proposed to increase the maximum penalty for malicious defaulters to 100 thousand rubles, or the amount of annual income: it is in excess of the loan which the borrower will have to pay in any case. It is also envisaged that instead of the fine lines were malicious can be punished by compulsory works for a term of 180 to 240 hours.

More severe punishment awaits those representatives of criminal structures, which are helping to deceive the banks, providing fraudsters with false documents. The current legislation for malicious defaulters a fine of 200-500 times the minimum wage or in the amount of income from two to five months. However, in any case “malice” intentions of the borrower must still be proven in court.

It is worth noting that the new draft law prepared by the MPs representing the banking community - the Association of Regional Banks of Russia. At the same time, the Ministry of Finance is currently preparing its draft amendments to the legislation, which would have been more favorable to the ordinary citizens.

Loan default has become a serious problem for many banks. According to statistics from the Central Bank, the amount of arrears on consumer credit at the end of last year amounted to more than 96 billion rubles. And some experts consider that figure too low in two and a half times.
