The State Duma has tightened Responsibility for corruption

MOSCOW, June 17 - RIA Novosti. The State Duma at the meeting on Friday passed in the second and third readings presidential law, reinforcing criminal liability for corruption offenses and increasing the maximum penalties for organizing the match-fixing and attempts to influence the outcome of sporting events by means of bribery.


The amendments

The law allows to recognize crimes cases where money or property is not to be transmitted when an official bribery, and at the direction of another person or entity. It also provides a terminological uniformity of the concept of “bribery” and “illegal transfer”, it is proposed to criminalize mediation in commercial bribery, and for such a promise.

In 2012-2015, the vast majority of criminal cases on the fact of commercial bribery, giving or receiving bribes was excited with the amount of less than 10 thousand rubles. Given a small public danger of such crimes, the law criminalizes commercial bribery, giving or accepting a bribe in the amount up to 10 thousand rubles, but establishes for them a lighter sentence.

It provides for increased liability for the fine commercial bribery and petty bribery committed by a person already convicted of these crimes. This measure is intended to prevent repeat offense. The law specifies the number of persons in respect of which it is possible provocation of commercial bribery or bribery. The list of penalties for commercial bribery and bribery, in addition to the fine, supplemented by other forms of criminal punishment: deprivation of liberty, together with, as the most severe form of punishment, at the discretion of the court as an additional penalty may be assigned to multiple fines.

The law increases the maximum penalty for the transfer of athletes, sports referee, coach, team leader, another participant or organizer of the official sports competitions of money, securities, property, as well as the provision of property-related services in the amount of 500 to 700 thousand rubles. The maximum term of imprisonment for such an offense is increased from four years with a fine of up to 50 thousand rubles to five years with a fine of up to 100 thousand rubles.

If an athlete, coach, team leader or another member of the official competitions, as well as member of the spectacular contest received a bribe, he would be in danger from 300 to 700 thousand rubles fine (currently a maximum of 500 000), or imprisonment for up to five years with a fine of up to 100 rubles (currently four years with a fine of up to 50 thousand rubles).

The law introduces penalties for mediation with conspiring to affect the outcome of the competition for a sum of 25 thousand rubles. As punishment, a fine of up to 500 thousand rubles or the salary for the period of up to six months, or by correctional labor up to two years, with disqualification to hold certain positions for three years, or by compulsory works for a term of four years, with disqualification to hold certain positions three years. The maximum penalty for mediation will be imprisonment for up to four years with a fine of up to 50 thousand rubles. For active assistance in solving the crime and the appearance of guilt committed crimes may be exempt from criminal liability. Also, criminal liability is removed from those who have been the victim of extortion.
